Where is Delta-8 Legal? A State List

Delta-8 THC Explained

Delta-8 is a psychoactive cannabinoid. It is minor in cannabis as it constitutes about 0.1 percent of the cannabis’ chemical composition. It is a very close cousin to its sister cannabinoid Delta-9, and most people are uncertain about how legal it is, seeing as Delta-9 is illegal.

Despite Delta 8 being psychoactive, it isn’t as potent as Delta 9. It is used as one of the main ingredients in our Delta-8 THC flowers product. 

What makes it unique?

Unlike its sister relative, delta-9, delta-8 has a lower psychoactive potency. Also, it has a direct bond with the CB1 and CB2 receptors found in the central nervous system. 

Is it Legal?

Thanks to the farm bill, we at GalaxyCBD can produce, manufacture and distribute CBD infused products. The passing of this bill also allows people make use of hemp in the US. CBD being cannabidiol, is a very dominant hemp compound, and you can take it in many forms instead of taking only the total chemical composition of the plant. It also applies to delta 8. It is legal federally as it comes from hemp and because it has not even up to 0.3 percent of THC. This percentage makes it a substance that is non-psychoactive technically, of course.

Now, you can understand why so many people don’t understand whether or not delta 8 is legal.  After all, D-8 is technically THC, which is the leading cannabinoid in marijuana. Hence its status is still as an illicit substance federally speaking.  

Delta-8 Laws and Regulations

Currently, of the 50 states in the US, 11 states find delta-8 illegal. According to the Agriculture Improvement Act of 2018; Section,297A, Sub-section. The term ‘hemp’ means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, CBD, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis. This law has guided us at Galaxy CBD in creating Delta 8 THC directed by law.

Also, the Federal Analogue Act mentions Delta 8 THC as part of its controlled substances. Its presence on that list is no longer critical with the Agriculture Improvement Act, known as the farm bill. This law is according to section 12619, subsection 2 of the constitution. This law showed tetrahydrocannabinol removed from hemp in general.

Can D-8 Show Up in Drug tests?

Most labs cannot differ between delta 8 and delta 9. Hence, even if your delta 8 is legal in your state, and you have to do a test, it might be read as delta 9 and lead to severe repercussions.

Steps On How to Produce Delta-8 THC

●     First Method: Extracting the Compound

To create a concentrate, you would have to isolate the delta 8 compound manually and then extract it from the main compound. This method is tiring and expensive because the delta 8 present in the hemp is not up to 0.1 %. Imagine how much hemp compound you would have to obtain before getting a reasonable amount of delta 8.

●     Alternative Method: Organizing and Rearranging the Compounds

This method is less expensive and works for most people. This process generally involves rearranging the atoms of the cannabidiol compound using molecular chemistry to become delta 8 compounds. This rearrangement is easy to do as delta 8 is an isomer of CBD. They both possess the same atoms in their respective molecules.

Delta 8 has not been in the market for a long time. However, a lot of confusion accrues to it due to always changing state laws.
